Crossing the Pipeline Easement

The Canadian Energy Regulator (CER), Damage Prevention Regulations—Authorizations (DPR-A) require third parties to obtain written consent for:

  • any mobile equipment or vehicle crossing of the pipeline off the traveled portion of a highway or public road, and
  • for installation of facilities (i.e. sheds, drainage systems, fences) within the easement, and
  • for ground disturbance within 30 meters of the pipeline.

Agricultural activity for the production of crops and the raising of animals and includes tillage, plowing, disking, harrowing and pasturing is permitted without a consent, if the following conditions are met:

  • Ground disturbance for cultivation is less than 45 cm deep, and
  • Loaded axle weight and tire pressures of the vehicle or mobile equipment are within the manufacturer’s approved limits and operating guidelines; and
  • No restrictions have been communicated by Maritimes & Northeast Pipeline.

Once you are in possession written consent, signed by both parties, Maritimes & Northeast Pipeline requires minimum of at least 72 hours (three full working days)’ notice before your planned work or crossing is carried out.
